The man, who has not been identified, will be charged with two misdemeanor counts of hunting out of season and one felony counts of illegal discharge of a firearm, the sheriff’s office said.

Jeffco Sheriff’s deputies are asking people to avoid the area of Lupine Drive in Evergreen to reduce the stress of a mother bear in a tree.

We are investigating the shooting of her two bear cubs earlier this morning.

The mother bear will likely not come down until people leave the area.

The incident started at approximately 5:15 a.m. today when a man was awakened by a mother bear and her two cubs going through his trash. He went outside and fired two rubber buckshot rounds from a shotgun.

During that time, his dog ran out. He said he was concerned about his dog's safety and he fired a third round, which was a live round. The live round struck the bear cubs, killing one instantly and wounding the other. The second cub was later euthanized by Colorado Parks and Wildlife.
The live round also struck a nearby house.

Deputies are working with Jefferson County Schools regarding changes to today’s drop off locations near this incident and they will continue to be on scene to ensure safety all day.

With bear sightings being extremely common this time of year, we’d like to remind folks of some safety tips when it comes to bear encounters.
If you see a bear:
• Stay calm
• don’t run
• Talk in a low, loud voice
• Avoid direct eye contact
• Back away slowly

I'm tired of wildlife suffering because of others' stupidity. This guy should not have had his trash out. Heaven forbid he takes responsibility for that. He doesn't deserve to live up here.

There was a comment made on our Facebook page wondering: "I don't understand why he is only being charged with hunting out of season, when it comes to the cubs. When it IS hunting season, you have to have a tag, be in the correct area, and cubs in a family unit are off limits. Where are the charges for those?"

Anyone have any idea? Might they add those charges later, or can't they if they've used the "hunting out of season charge"?

This person left his garbage out where there are bears all the time and because he did not want them to rip the trash up he shot at them. He was negligent on doing this and not making sure his dog was secured plus the bears posed no danger to him or his dog they were just getting into the trash.

The homes are very close in the neighborhood and he should not have even of thought of firing a gun. The story does say that the house next door was hit when he shot the bullet/shell.

I am sure if he would have called the police they would have come and chased the bears away.

If you are afraid please buy yourself a simple air horn and use it first before shooting a bullet.

If you are negligent and leave trash and stuff out well guess what you are going to get to clean it up.

We had a little guy years ago that would climb our deck (no stairs) and eat the plants my wife planted (tomatoes, strawberries, herbs) the air horn worked great it scared him to death once I caught him in the act and he never climbed the deck again.

I am sure that this guy is very sorry for what he did and hopefully he will be educated on the ways of the mountains.
