What he did first wasn't the main issue. The DOW will provide shotshells with beanbags exactly for that purpose (I suppose the rubber ones are similar). What he did wrong was escalating it to actual shot instead. Sad to see 2 cubs killed over an irresponsible person. Leaving out their trash will eventually get the bears killed anyway.

Too bad future generations aren't here to see all the great things we are spending their $$ on!!

Sheriff’s Office Investigators have completed their investigation into the shooting of two bear cubs yesterday and have presented the case to the District Attorney’s Office.

A list of potential charges that homeowner Daniel C. Williams (DOB 031965), of the 27000 block of Lupine Drive, may face includes:

• Illegal discharge of a firearm (felony)
• Reckless endangerment (misdemeanor)
• Shooting from or across a public roadway (misdemeanor)
• Dogs harassing wildlife (misdemeanor)
• Illegal possession of wildlife (misdemeanor)
• Unlawful taking of a black bear out of season (misdemeanor)

At approximately 5:15 a.m. on Tuesday, Sept. 1, Williams was awakened by a mother bear and her two cubs going through his trash. He went outside and fired two rubber buckshot rounds from a shotgun. During that time, his dog ran out. He said he was concerned about his dog's safety and he fired a third round, which was a live round. The live round struck the bear cubs, killing one instantly and wounding the other. The second cub was later euthanized by Colorado Parks and Wildlife. The live round also struck a nearby house.

With bear sightings being extremely common this time of year, we’d like to remind folks of some safety tips when it comes to bear encounters.

If you see a bear:
• Stay calm
• don’t run
• Talk in a low, loud voice
• Avoid direct eye contact
• Back away slowly

District Attorney Files Charges in Bear Shooting in Evergreen

First Judicial District Attorney Pete Weir announced today that charges have been filed against Daniel Clay Williams, DOB: 3-19-65, in the shooting of two bear cubs in Evergreen earlier this week.

The Jefferson County Sheriff's Office was called to 27876 Lupine Drive early in the morning of September 1st regarding shots having been fired. When deputies responded they found two seriously injured bear cubs. Colorado Parks and Wildlife was also called to the residence.

Due to the severity of their injuries, the cubs were subsequently euthanized. There was also an adult female bear who had moved away from the residence and climbed a tree across the street.

Mr. Williams is alleged to have fired two rubber bullets, and then one lethal shot, at the female bear and two cubs. The one lethal shot traveled across the street hitting, and breaking, a window of an occupied house.

Mr. Williams has been charged with two felony counts and six misdemeanor counts. The counts are:
• Illegal Discharge of a Firearm - Dwelling (F5)
• Aggravated Cruelty to Animal (F6)
• 3 counts of Black Bear Hunting Out of Season (M1)
• 2 counts of Illegal Possession of Wildlife (M)
• Shooting from a Public Road (M)

Pursuant to state statute and procedures, the District Attorney has requested that the court issue a felony summons for Mr. Williams. The Jefferson Count Court will issue the summons and notify us with the date of his first appearance.

If convicted of the felony counts, Mr. Williams could potentially face up to 4.5 years in prison. Each of the misdemeanor counts carries a potential county jail sentence and significant fines.

This message below was posted in one of the local Facebook groups and this statement compels me to speak up. If you have issues with the way a local business is doing something, it is incumbent upon you to try to resolve it first privately, and then to take the issue public with just the facts if nothing is done. What I absolutely condemn is the malicious, passive-aggressive, underhanded, ILLEGAL retaliations being inflicted upon this local business owner. Go and talk to him before passing judgement, or better yet, find some way to help him. He posted in a different group earlier this week that someone called Jeffco on him about his trash being strewn about his dumpsters on Tuesday so he booked it over to his restaurant. Sure enough, the bears had pried up the metal bars that were supposed to keep them out and gotten into the dumpster. He tried calling friends and employees to ask for help in moving the dumpster back to where it was supposed to be because it was too heavy to move himself, couldn't get hold of anyone, so he started cleaning everything up by hand. He said several cars stopped on the road that goes past his establishment - not to get out and help, but to take pictures. Seriously?

Be part of the solution, not just a complainer. It's the right thing to do. It's the neighborly thing to do.

Now, in regards to the man who shot the bear cubs and the vitriol I've seen elsewhere online regarding him. Yes, he made some very bad choices and he is facing very serious consequences and the law will be served. Again, I do not condone these kinds of personal attacks that call for harming him, harassing him and his family at their home, or for boycotting his business. Posts of this nature will be moved from this forum to our Ring, and/or edited if containing personal information. If you wish to not patronize his business that is your prerogative, but you can do that privately. We have evolved to create a justice system so that we no longer "take care of things" through unfair, subjective, emotionally-driven vigilante actions. Get involved in the proper process if you wish to see that justice is served.

Along those lines, we will also be posting information shortly about online harassment and a recent Colorado law that will affect you should you choose to do any of the above elsewhere.

"I spoke to the owner of the Brook Forest Inn. I was pleasantly surprised by the call and disturbed by our "community". He has been working with Waste Management for some time about the trash. He has installed metal bear bars several times and the bears just bend them. He tries to pick up the trash when it is knocked over but the dumpsters are heavy and he needs the staff there to do it. Hence the trash Monday and Tuesday. Waste Management is working with him and brought him two new dumpsters today with heavier metal but the bears have figured out how to go under the bear bars and bend them so he is going to fold down all shipping boxes and put them on top to try and prevent the bears from getting under. He is pretty bear savvy. He does NOT want to leave the area. His FB page was hacked with awful comments so he took it down. He is working with Waste Management to make twice a week pick ups. He had a fence but the bears tore it down and you can see the metal posts where it used to be. Someone sent him info about sturdy bear dumpsters that cost $5,000 each but Waste Management won't pick up the trash if he doesn't use their stuff and they are the only ones that do businesses up here. He and has family have had death threats, threats of burning the business down, he has had sugar in his gas tank. He is doing what he can. He is willing to speak to me any time if anyone has any further questions but with emotion so high right now wants to take a step back from online response. If you have further questions or suggestions for him, please let me know and I will ask. Again, if you had a hostile approach from him perhaps he just spent a ton from sugar in his tank, death threats or hostile questions on the other end. I was satisfied.

Jeffco commissioners reluctant to consider bear-proof trash ordinance
A group of Evergreen residents may want to propose county mandate to secure trash

Some residents in Evergreen want the county to adopt a trash ordinance following a recent incident in which a resident shot and killed two bear cubs when they were getting into his trash.

Channing created an informal online survey that asked area residents whether they would support an ordinance that required secure, bear-proof trash storage with fines for noncompliance. After a week, it got around 175 responses reflecting support .

She said she and a handful of other community members are drafting something similar to what Eagle County requires of its unincorporated areas . Its rules apply only to areas that have five or more calls about bears or one trapped or killed within one calendar year.

But county commissioners, who would ultimately approve such an ordinance, say there are challenges with cost and enforcement and they do not see regulation as the best option.

Rosier said an ordinance would be like "going from zero to 60," skipping other steps such as increasing education and outreach.

Jennifer Churchill, a spokesperson for Colorado Parks and Wildlife, said the department has a Bear Aware volunteer program that is a network of volunteers who educate their neighbors and communities about coexisting with bears.
