It's a duty to retreat because you can be shot if you don't. In other words, non-gun owners don't have the right to stand their ground against a gun owner, in Florida. The gun owner's right is law. There is no similar "right" in the law for a non-gun owner.

In this case the non-gun owner was drunk and had committed the offense of breaking and entering. He placed himself in a situation where a home owner was protecting his family.

The dead person placed himself in a dangerous situation. The home owner was not obliged to look after the welfare of the person who had broken into his home, but rather he was obliged to protect his family.

So much for your welfare state of everyone looking out for the miscreant.

Like the drunk who went to the wrong house ( here in CO) and tried to get in, he was shot a killed.

When the gun owner went over the noisy party and kicked in the door then he could have been shot dead, too. The guy who died wasn't the only one who broke into a home that night.
