According to 35 USC 10, section 176, it is a violation of this federal statute to fly the flag upside down except in extreme danger to life or property.

(a) The flag should never be displayed with the union down, except as a signal of dire distress in instances of extreme danger to life or property.

One man's "dire distress" is another man's joy. It's a picture, not the actual flag. He only put it up so people would get all hot and bothered about it.
