Supreme Court Rejects Appeal On Guns In Public

WASHINGTON (AP) — The Supreme Court has turned away another case over whether Americans have a constitutional right to be armed in public.

The justices on Monday let stand a lower court ruling upholding a New Jersey requirement for gun owners to show an urgent need to carry a handgun outside their home for self-defense. Both a police official and a judge must approve the permits.

The New Jersey law was challenged by four individuals and two gun groups, and had the backing of 19 states.

The justices turned away similar questions on at least two earlier occasions.



Ooopsie... I guess the states have a right to set their own limits after all....

Like "separate but equal", this unconstitutional infringement will continue to be challenged until it is eventually overturned by a court that adheres to reason instead of attempting to implement a political ideology. It may be the latest challenge, but I can assure you it will not be the last . . .

Federal Judge Upholds DC Gun Control Law

WASHINGTON (AP) — A federal judge has upheld the gun-control law in the District of Columbia, which bans assault weapons and large-capacity magazines while imposing registration requirements for handguns and long guns.

In a ruling Thursday, U.S. District Judge James Boasberg said the city seeks to combat gun violence and promote public safety and that the current law does so in a constitutionally permissible manner.

The District of Columbia previously had one of the most strict gun control laws in the nation, but it was struck down in 2008 when the Supreme Court concluded that that the Second Amendment protects handgun possession for self-defense in the home.

The law upheld Thursday seeks to accommodate that constitutional right while also protecting the community from gun violence.


I guess the rules covering local control are still in force... While "handgun possession for self-defense in the home" was upheld, so was the right of the community to control guns outside of the home....

I think you meant David Gregory...And no, he was not prosecuted for the "technical violation" of displaying one on TV to show the audience what it looked like.

You are correct, David Gregory was able to weasel out of charges despite having in his possesion a hi-cap magazine. Hundreds of people across the nation were witnesses. (Ratings have really plunged since Russert died.)

A federal judge interested in expanding federal power has ruled against the citizens. This is somehow surprising? That a ruling has been issued is in no way establishes that a correct ruling was issued. This ruling, as has so many others issued by the courts in the course of the Union's history, is wrong today, will be wrong tomorrow and will be wrong until it is eventually overturned. This is not the last challenge that will be made to these unconstitutional laws, nor should it be. Like separate but equal, they will be rightfully challenged until a judge, or a panel of them, adheres to their oath and the Constitution and overturns the law.
