In defence of LJ, she rarely attacks unprovoked, she does though, respond in kind. If everyone toned the rhetoric down a few notches we can actually have discussions, may not have any more agreement but at least we can discuss like civil folk.....

Which is what makes him the most powerful SCOTUS justice around for the foreseeable future. We have 4 constructionists, 4 revisionists and one who seems a bit schizophrenic to both sides from time to time. Kennedy is the one who decided that the government can seize your private property and give it to another private interest to swell the tax coffers of a local government and also the one who decided that the 2nd Amendment should be incorporated to put it on an equal footing with most of the other amendments adopted at the same time.

If I had to pick which choice he'd make in this instance, I really wouldn't want to bet much more than the pocket change I carry, but I do hope and pray that he sides with this judge in Virginia when the process gets that far, as we all knew it would. We all know as well that without the individual mandate there will not really be an opportunity to implement the rest of the law as the Democrats were counting on this part of it to provide the funds for the rest of their, to use the judge's words, scheme, and was a critical part of getting many groups to endorse the legislation. It is also pretty well understood that if an insurance company must provide coverage, regardless or any existing conditions, and that said coverage must be provided under a community rate scenario, there will be no private insurance companies in this nation because they will not have any policy subscribers until such time as the person becomes ill and there will therefore be insufficient funds available to pay the insurance claims presented to treat the condition of the recently enrolled subscriber.

Hide and watch folks. If/when this funding scheme is struck down, the next attempt made will be along the lines of further taxing you for the privilege of being employed and taxing your employer for the privilege of having employees ala Social Security and Medicare.......

Remember when and where you first heard that prognostication........

If it finally leads to universal health-care, bring it on.

You betcha. Look how well it has worked out for Medicare, which only confiscates about 45% of its annual budget from the general funds of the treasury and is one of the many social welfare programs that have driven us into a national debt of some $14 Trillion dollars and current unfunded liabilities for many times that amount. But hey, when you have a group of folks that think you can dig yourself out of a hole, there is no such thing as a fallacy of logic anylonger.......

Took the words right out of my mouth. I was driving along today switching between Rush Limbaugh and Thom Hartman. Thom thinks that if a r is elected pres in'12 it will lead to a Mussolini and Rush thinks we already elected him.

put pressure on the senate and house reps to not fund it, no matter what scotus decides. and use the next 2012 election to vote reps who will do the will of the people.

Interesting comments on this decision and issues with the judge's reasonings on the Volkh conspiracy which is a relatively conservative/liberatian blog.
