The Ark decision specifically referenced that Ark's parents were "domiciled residents of the United States, having previously established and still enjoying a permanent domicil and residence therein at San Francisco". Illegal aliens cannot be "domiciled residents" of the United States, their illegal presence in the country in fact precludes them from being considered as enjoying a permanent domicil and residence within the nation.
