read the flume article and it indicated that in part there was a failure to state a claim for relief. if true then there would be little chance to go up on appeal. appeals can only argue the issues the judge ruled on showing that he erred, not the merits of your claim per se.
but what should be most helpful is having the attorney tell you how to file your claim so that it doesn't get dismissed. i don't think this will be the first or the last. the commissioners just keep on spending never mind the money won't be there. it has to stop.

Failure to state a claim for relief is the failure to establish a cause of the action, not a failure to ask for relief. IMO.
We established a cause as well. The County Attorney and others involved on that end, as well as the judge may very well end up surprised at the result.
