I have talked with several people both in Jeffco and Park County who all received the same Official State of Colorado Notice of Opportunity for Foreclosure Deferment on JUNE 1 with a deadline for contacting a hud-approved forclosure counselor of JUNE 21. All have said notices were left on mailboxes either on county property or in common areas. Take note according to Revision 4 of the Law 38-38-805 this is an Illegal Act. Notice must be posted on property in question and if left in common area, (such as condo common area) it must be inside a White Envelope with the property owner's name printed clearly on the envelope.
Seems there is a new wave of foreclosures up here. When you call the Colorado Foreclosure Prevention Hotline as outlined on the notice you are asked to enter your zip code for routing to the HUD approved counselor. Everyone in the mountain communities here is directed to the same Non-Profit Agency in Englewood. Because of the number of notices which are being followed by notice from county trustees via mail which include foreclosure sales dates this is a time sensitive matter. People are being given 20 days to contact Counselors to be eligible for this deferment.
PROBLEM IS too many needing assistance for deferment all at once and not enough Counselors to handle the influx.
If you have received one of these notices you are NOT ALONE.

Thanks, akilina. Most everyone we've talked to has said the same thing, that the notices are taped to their mailboxes somehow. We know of at least two, one taped directly across the top of a mailbox, and the other taped to a specific mailbox in one of those "community" mailbox banks, both in plain view and subject to everyone in the area with a mailbox in that location being able to see what they are and to whom they pertain.
The law states very clearly how these notices are to be served, and we have yet to hear of one being served according to that law. Also, it is our understanding that attorneys for mortgage servicers are usually the ones who are doing this because it is now required by law that they must notify homeowners who've gone into default they may be able to get a 90 day deferment on the foreclosure sale date. The attorney's name that seems to be a common denominator so far in all of this is Aronowitz and Mecklenburg, LLP. The whole deferment thing is misleading because even if a homeowner can get one, it doesn't necessarily mean the foreclosure will stop, and probably won't.
Anyway, we're hoping to hear from others who've experienced this, because our intent is to get as many people as we can together to file a single "complaint" about it with the respective county public trustees, district attorneys offices, and the state attorney general's office. We believe if more people "empowered" themselves, the illegalities surrounding what the banks and their robo-attorneys are doing in the foreclosure mess might at least be slowed down if not stopped altogether. And there are many illegalities that need to be addressed, IMO.

I was originally going to suggest that you contact Aronowitz et all as I am familiar with them, but I see that you are working to stop a practice that might include more than this firm.

After checking with both the Colorado Department of Local Affairs, whose logo is printed on the form, and the Jeffco Public Trustee's office these notices are real and are followed by notice of foreclosure sale in the mail.
Because of the posting manner being used (i.e.: mailbox postings first) the impression given is that it might be a scam. IT IS NOT.
As clearly stated in Revision 4 of the law, the notice must be posted on the property in question or otherwise in a white envelope
with the owners names printed on the envelope, for privacy purposes.
ARNOWITZ AND MECKLENBURG, LLP is the attorney firm on the notices we've seen, as holder for the trust moving to foreclose.
What we are learning now is most of this new wave of foreclosures here in the mountains are due to STATED INCOME LOANS. These loans are
not FHA insured loans. Therefore it is more beneficial for the INVESTORS to foreclose and get the properties off their books. Possibly considered unsecured debt due to new SEC rules and laws.
The NUMBER OF COMPLAINTS IS IMPORTANT regardless of what county people live in, and regardless of how many complainants on each complaint filed.
ZHawke, checked several banks of mailboxes in the Burland area but did not find any open letters. We also contacted some that we know who are in foreclosure but they are much further along in the process. I did ask them if they found an open letter on or near their mailbox, negative but many weren't looking. I also asked if the attorneys in foreclosure are Aronowitz and Mecklenburg, negative. But it was only a few individuals that we talked with.
I did see in The Flume Legal Notices in the online addition that there is at least one filing with the above named attorneys but not familiar with this family.
I hope the word does get out to check on or near mailboxes for anyone who is moving closer to foreclosure and file a complaint.

Thanks, akilina. The statement you make about "many weren't looking" is what goes directly to this problem in my opinion. That's what these attorneys are counting on. In the "other" message board up here, we've already gotten several replies on this issue where people have received these types of notices in the manner we're talking about. What we are also trying to get out there is that "business as usual" in the foreclosure mess should no longer be acceptable to anyone, much less those actually facing foreclosure. Far too often, people just "roll over" for any number of reasons including embarrassment, a feeling of failure, being made to feel like criminals, and the list goes on. If homeowner's feet are going to be held to the fire, so to speak, and their "moral obligation" to pay their debts continues to be a hammer held over their collective heads, then so should the moral obligation of the lenders, their robo-attorneys, the investors who bought bits and pieces of the "pooled" mortgage derivatives that have been sold and resold until there is no securitized mortgage left to foreclose on. They also have a "moral obligation", in our opinion, to quit playing their games and do what's right for everyone, not just their own bottom line.
