Thank you and yes the roads are really bad. 285 is shut down multiple accidents including a 10 car pile up at myers ranch. I hope everyone stays safe its bad out there.

It has now been confirmed that this effects many other people in Park County. This is terrible and I do not wish this upon anyone. If you know of anyone else or you are a person this now effects please reach out to Ryan Luby. His contact information is in the article. The statute of limitations is 3 years I believe from the date of sale. I am not a 100% on that. Protect your selves.

Park County has MANY problems not addressed, it is a very large rural POOR county....there is not sufficient revenue (one of the reasons people elect to move to Parkco because of the tax
base)......not saying it;s right or that you do not have grounds (realtor should have had O&E
insurance and did her due diligence)...... I am elated you did not give up but rather FOUGHT HARD for justice ..... again make yourself heard, it makes a difference.....NOT easy to do but worth the fight,.

The County can easily , but at a cost clear this issue with the voters by conducting a review of ALL COs and publish the results in the media(online I do suggest). No citizen should have to wade through the clerks and courts and citizens pay all the salaries of the clerks up front. Commissioners can act....or not. This permits a seller and a buyer to ascertain the status up front before exploring a sale from either side. Commissioners can examine the record keeping and processes in other counties as a start.

We, too, discovered that our home didn’t have a C.O. when we talked to building dept about opening a permit for the remodel. Similar issue...no realtor, title company ever disclosed as never having C.O., and it was always purchased with cash so no loans or banks to request the C.O. and no chance of foreclosure.
Our family purchased in the mid 90s and are the 4th owners of the property.
Our home was built in the 70s and never had the final inspection at all according to the county records. Long story long...we had to basically gut the place down to the studs and start over since the state couldn’t locate the original electrical and plumbing inspection reports.
It’s been a long nightmare and we were shocked it could’ve been sold without somebody catching the lack of a C.O. - we too were told that title companies don’t check and even the county doesn’t flag it when it’s sold (assessors office doesn’t seem to talk to the building dept when sold).

It still makes me sad every time I hear this. I am sorry for your situation. I wish more people would come forward and join our fight. Unacceptable that this has been going on for so long, causing so many problems for innocent people. Not to mention all those that lost their homes from this mess and moved on, choosing to remain silent now and not bring the nightmare they went through back up.

Our disaster took us down an unexpected path, as it was not possible for us to come up with the money for repairs. We exhausted every option possible to prevent us from losing our home. By the end of last year, we were forced to vacate our home with no where to go. The lender offered absolutely no assistance and actually threatened us to continue making the payments. Still facing an uphill battle to recover anything, this situation has tremendously devestated our finances, drained our savings that took years to accumulate, our credit has plummeted while we still remain homeless. We wont recover from this for a long, long time.

Also, how was your property taxed? Did the assessors office still send you a bill for a completed, finished, livable home as they did to us knowing that it was not even safe to live in? I bet they did.

Recenlty came across this article, reveals more information regarding how the county handles things. Just blows my mind. It has to stop.

We spent an entire day in Fairplay in just about every county office looking through records. We have been taxed as a dwelling as far back as we’ve owned the property and I believe since the mid-late 70s.
We had a long discussion with the assessors office about how they change from vacant lot to an improved property or dwelling. They don’t wait for a certificate of occupancy, it seems they change as soon as the permit is opened.
We did find out that the tax rate for vacant land is CONSIDERABLY higher than a dwelling, so we didn’t really want to poke that bear too hard.
Are you making any progress through the lawyer? I left him a message about our situation but haven’t heard back.
We are hoping to go through final inspection in the next couple of weeks and finally be through this expensive nightmare.
