Moquist sentenced to 20 years

Jarrod Devon Moquist, 28, of Fairplay was sentenced to 20 years in prison last month, convicted of murder in the second degree of Evan Graham, assault with a deadly weapon, tampering with evidence and abuse of a corpse. He was also ordered to pay $877.50 in assessed fines and court costs. He was sentenced April 4.

Moquist confessed that he murdered Graham in June 2013, but his defense argued in court that he was within his rights under the Colorado Homeowners Protection Law, otherwise known as the Make My Day law, to shoot Graham because Graham entered Moquist’s recreational vehicle without permission.

The jury went into deliberations Thursday, Feb. 4, at about 2 p.m. and came back with a verdict the next day. Fred Whitaker was one of those jurists and he spoke to The Flume about some of the deliberations that took place in the jury room.
