The Emancipation Proclamation was an Executive Order. The desegregation of the U.S. Armed Forces was an Executive Order.

Obviously our president is not "voting present" on these issues. He's criticized if he does nothing and criticized if he does. Dealing with partisan second guessing comes with the territory.

The executive orders are not being created to tell the executive department to enforce the laws that Congress passes. The executive orders are being used to create laws.
Where in the Constitution is this authorized?
