Although the text of legislation states that such data would remain the property of the owner of the vehicle, the government would have the power to access it in a number of circumstances, including by court order, if the owner consents to make it available, and pursuant to an investigation or inspection conducted by the Secretary of Transportation.


Once your car taps another, my sense is the govt can do anything it wants to that car. Imagine having a head on crash, having the cops show up, the tow truck and how it would go if you told them not to touch your car, even if it was out of traffic....good luck. Once you touch another car, you really give up most of your ownership and control rights to your car. Doesn't the same go for your house if someone that does not like you calls the cops and says I hear a lot of yelling over there. Try and stop that cop at your door or the end of your driveway. You lost your ownership rights once the guy made the call.

The court will not help you much here.

This also will not matter. Most people in the US must have insurance. Soon most insurance will require these boxes to be transmitting back to them in real time our your insurance will go up 5 fold. You will gladly ask them for these devices the same way you asked to have a tracking GPS on you at all times via your phone, you will go up to a counter or make a call and trade them a lot of money for the device that you don't like, in order to keep driving, even in your '48 chevy pickup. You will even update the wiring and brakes to accommodate it (so they will let you register it), you will do it all, and gladly. The regs were not even needed, private industry would have convinced you to give this up in a matter of 10-30 months with no govt involvement with the benefit of real time, not just black box data.

Any bets. or just ignore?

Also this concerns me far less than other things like having phone calls listened to. When you are driving, you don't really consider yourself in a private place and it is not a right, by any means - driving.

This sucks all the way around. Once again to make this mandatory is against what being a free country is all about. Money is America's religion and it is obvious the insurance companies are behind it. This freaks me out.

I agree CG, I'm more upset about the mandated equipment and added costs of things I wouldn't choose to buy. The DOT czar has been mandating car design for many years.

Tire pressure sensors
Back up camera
Auto stability control drive-by wire
Black boxes

and the list keeps on growing.

Here is the data they save (for now). LOL I'm sure the DOT czar can probably revise this list in the future without a new law.

So there is some value to having this data for vehicle safety research, air bag design and performance etc. The question is how will the insurance companies and lawyers use the data, and what new data will be added in the future?


Current required EDR data elements are:
-Delta-V, longitudinal
-Maximum delta-V,longitudinal
-Time, maximum delta-V
-Speed, vehicle indicated
-Engine throttle, % full (or accelerator pedal, % full)
-Service brake, on/off
-Ignition cycle, crash
-Ignition cycle,download
-Safety belt status, driver
-Frontal air bag warning lamp, on/off
-Frontal air bag deployment, time to deploy, in the case of a single stage air bag, or time to first stage deployment, in the case of a multi-stage air bag, driver
-Frontal air bag deployment, time to deploy, in the case of a single stage air bag, or time to first stage deployment, in the case of a multi-stage air bag, right front passenger
-Multi-event, number of events (1,2)
-Time from event 1 to 2
-Complete file recorded(yes, no)
