What are you talking about?? You have other "facts"?
This is where states rights can come in. People can move to states with better regs, in fact, they could have done that at any time.
Some states don't allow the insurance company to ask anything except for the person's age and proof of residency...that's it. But warning, I have lived in those garr issue states and you don't get health care there unless you pay for it (the plans you can afford will only cover major stuff, not general care). When I got a cold in CO, I went to the doc using my cheaper insurance and got care for what I was paying and a minor copay. I imagine that the health care that most can afford will go down because of the ACA because it brings everyone in line with the states where everyone has coverage, but many go without basic care.
But they should be able to ask anything really, otherwise they don't know what they are getting into and then costs get passed around.
The new health care law was designed to make sure costs don't get passed around. We will have a new, very un-natural imballance of power and resources and in stead of people owning their own decisions, the govt will own the decision and thus be at fault for the future failure.
Soon enough, your weight will be factored into your taxes. Too bad the people that wanted the ACA made sure we will have to wait decades longer for universal care. The real sad part is how many poor people will suffer so that middle class people can feel good about what they have done to them.
