Lucky for the bad guy that the home owner called 911 first and stayed on the phone with the dispatcher. He could have waited for the door to pop open and defend himself and his home first and call 911 after the fact, he might have decided three rounds wasn't enough.
We need more information to close the case:
- Do the parties involved know each other? If so, have there been any disagreements between them that lead up to the event?
- Does either party have a criminal past? If so what were the charges, how many convictions?
- Hate crime? White guy busting down the door to intimidate minority occupants or vice-a-versa?
- Is this exactly what it looks like? A garden variety thug busting into houses to steal anything he can fence.
Assuming it's the last option on the list I want to believe that the average jury would side with the shooter.
Not sure if Oklahoma has a "make my day" law or not but, is it unreasonable to think that a dozen citizens (despite having an aggregate IQ around room temp and fourth grade reading comprehension) could conclude that the aggressor broke the law by forcing entry into the home? Probably a rhetorical question, these would be the same people that re-elected Obama...
