If this little girl is consistently making a profit on her cupcakes then IMHO, her business and product have bested the test of caveat emptor (let the buyer beware). If no one is complaining about her product then why is the local health department involved?
She must be a huge threat to local businesses and the health and general well being of the public...

Power corrupts, Fred. If we are content to be sheep then even petty piss ant bureaucrats are happy to step up to be sheep dogs. Given the # of threads like this I have started that get no response from the left I guess they are ok being sheep as long as the dog is a d. Government is always there to protect us from our own decisions. I just went to a chili cookoff at my kid's middle school and sampled at least 20 different amateur non-licensed, non-inspected chillis along with homemade brownies and cookies. Needless to say, I went home with a stomach ache but it was for a good cause. These power hungry bureaucrats always have to keep our decisions in check for our own good and I will always use my own judgment over that of some elected scumbag whenever possible.
If I see a kid with a lemonade stand that hasn't yet been shut down, I will go out of my way to help that kid learn how to be self sufficient and see what it feels like to make your own way... even if I risk getting sick.
