POSTED PROPERTY

POSTED PROPERTY was created by deltamrey
I have been told in another posting that Deer Creek Valley Ranch Managers have threatened a citizen for looking for a lost dog recently with criminal; trespass. The property IS NOT POSTED.......I suggest the owners of that property post it consistent with current statutes. This would be consistent with the law and most helpful.

Here is the law as codified:

5-4-3. Trespass. Go to the top

No person shall:

(a) Enter or remain upon land or premises other than a dwelling of another in defiance of a legal request or order by the owner or some other authorized person; or

(b) Enter into or upon land or a building other than a dwelling that is posted, locked, or otherwise fenced or enclosed in such a manner that a reasonably prudent person would understand that the owner does not want any such person on the land or in the building.

JEFFCO Deputies told me I must post the property......I only assume Park County would also require the same courtesy for the unaware citizens. POSTING of this property is not evident.

Big entry gate, entirely fenced, what part are you not understanding? The sign they have inviting people onto the property is "wedding" Seriously? It is a large property and I do know the owners in passing, but you really have no right to invade thier privacy or ranch operations.

I do hope you find your dog.

Such a cute play on words, I ASSume nothing. If you want access to their property call them and request it. Otherwise they have every right to request you vacate the property. If you drive up my driveway, I will request that you leave. I do not need a sign to alert you that you are trespassing.

Read the code. Agree IF a citizen enters any private property and are asked to leave by the owner or property manager, they must vacate.

if you think your dog is on their property, call them. www.deercreekvalleyranch.com/#!contact-us
Wow that took a lot of effort. What I dont understand is you lost your dog. Goodness knows it has happened to me a time or 30 times. Why bash the neighbors? Drive up, honk the horn. Request permission.

We have made contact with the OWNERS......the two knuckledraggers that harassed my neighbors have no standing at all......we will handle this accordingly via the real owner.

Thanks for your interest, Blondi,.

Yes, the code.

"otherwise fenced or enclosed in such a manner that a reasonably prudent person would understand that the owner does not want any such person on the land"

If the property is fenced and normally gated and your friend is reasonably prudent, it sounds like trespassing to me. Signs or no signs. The code you quoted does not say it needs to be posted or at what frequency the signs need to be posted.

How was the property accessed?
