An 8 person Supreme Court is preferable

There is no constitutional requirement as to the number of Supreme Court justices. With the current 4/4 split there will be less legislating from the Bench, hopefully.

I agree. When you are setting national precedents, I prefer 5-3 decisions over 5-4.
