Strategy? Maybe Biden/Harris don't want to charge Trump. If he isn't charged, he can come back in 2024 and they can beat him again. As opposed to a younger, more intelligent opponent.
Leaving Trump as is might damage the GOP. If he gets convicted, the party can wash their hands of him and move on to better candidates with fewer negatives.
