Maybe. The Supreme Court might just decide the 10th Amendment applies here. States should be able to ban certain drugs that they see as dangerous. Or does the Interstate Commerce Clause take precedent?

The government once again puts the burden on the middleman. If these drugs are banned in a state then the M.D. writing the script is acting illegally. Rather than go after the doctor the government chose to aim at the pharmacist. Also since the drugs are banned in the state they should not be stocked in the pharmacy, if stocked, the pharmacy is in violation of state law.
It will be interesting to see if there is any enforcement on the part of the Feds or are they just blowing smoke.
