SMH . . . Archivist won't certify the failed amendment no matter what Biden says and any unilateral action would be quickly struck down by courts which have already affirmed the validity of the ratification deadline imposed by Congress when the amendment was proposed.
Just because the 27th Amendment was ratified 2 centuries after being proposed, with no deadline set by Congress for ratification when it was sent to the States, doesn't mean every amendment is permitted to enjoy such a long life span.
I know, I know, 18 of the 27 amendments to the federal charter didn't have ratification deadlines, but the ERA did have one, and it ended in 1982, 18 years before the 38th State, Virginia(?), voted to adopt the amendment; and did so more as a ceremonial nod to the times than any actual attempt to add the language to the federal charter.
