The court trying to find a way to implement a decision was the fundamental problem with Roe. As Jackson so famously pointed out, the court has no means of enforcing a decision, that duty rests on the executive and the legislative branches.
So, implementation could be as simple as an executive department rule requiring every State to include a checkbox on the official Certificate of Live Birth about the status of the mother and father of children born in that State before a child can receive a SSN, and the SSN is required to file federal taxes where a child is claimed as a dependent. The EO already tasks the Commissioner of Social Security to take all appropriate measures to ensure that the regulations and policies of their respective departments and agencies are consistent with the order.
