Supreme Court Debates Birthright Citizenship Today

A few of the Justices seem to be tipping their hands and agreeing that just because your Chinese child was born on American soil, it doesn't automatically grant him citizenship.

The fact that we have a birth tourism industry should have convinced every justice to end it... 5 minute decision max. The system will not allow logic to prevail.

The left is angry because they are now being judged by the content of their character and not by the color of their skin.

If the Justices take away BirthrightCitizenship, they might have to decide how to implement it

Give amnesty for all born in 2026 and before? Take away Birthright Citizenship from everyone? Give Temporary three year visas to current holders? Lots to untangle.

The court trying to find a way to implement a decision was the fundamental problem with Roe. As Jackson so famously pointed out, the court has no means of enforcing a decision, that duty rests on the executive and the legislative branches.

So, implementation could be as simple as an executive department rule requiring every State to include a checkbox on the official Certificate of Live Birth about the status of the mother and father of children born in that State before a child can receive a SSN, and the SSN is required to file federal taxes where a child is claimed as a dependent. The EO already tasks the Commissioner of Social Security to take all appropriate measures to ensure that the regulations and policies of their respective departments and agencies are consistent with the order. Quick fix.

June is actually a pretty quick time frame. Dobbs was over 6 months between oral arguments and an announced decision.
