Supreme Court Justice Schools the Tea Party

by John Brandt | January 24, 2011

Members of the Tea Party Caucus led by Rep. Michele Bachmann, R-Minn., along with other House members, received a master class on the Constitution from Supreme Court Justice Antonin Scalia Monday evening.

Scalia, a 24-year veteran of the nation's highest court, was invited to give a lecture followed by a question and answer session to members and staff on relations between the three coequal branches of government. The discussion took place at the Capitol and was closed to the press.

However, several members spoke Fox News following the presentation, most praising Scalia. "He has a unique ability to talk about very complex issues in a simple manner," said freshman Rep. Michael Grimm, R-N.Y.

So much for the concept of SCOTUS "impartiality"... But then, with Scalia, Thomas, Roberts and Alito, it never was in question anyway...

How could this possibly affect his impartiality? A group of lawmakers wanted to learn more about the three branches of government and their interactions. They invited an expert to lecture and for question and answers. Even democrats in attendance said it a was interesing and informative. Tha same groupis extending invitiatins to liberal justices as well.

There were some biased crackpots looking for an outrage of the day to bog about that claim the mostly conservative audience might somehow influence Scalia. What a load of crap. Scalia has had many question and answer sessions with liberal audienes - did that sway his views? Do you really think Scalia is that much of a political chameleon?

Nothing. Nothing at all. I was just curious how you thought this lecture would affect his impartiality, as you stated.

Why didn't you just post something that said "Damn the Conservatives!!!!!!!"? I think it would have better addressed your point.

thanks for the link. would have loved to sit in on that session. like scalia's recommendation of reading the federalist papers.

Scalia provided some reading recommendations for the members, "He said we should all get a copy of the Federalist Papers and read it, underline it, dog-ear it," Schakowsky said.

While I personally am somewhat concerned about this, apparently there isn't a ethical problem with it so I hope for the best. Certainly more dialog is better than none.

Justice Scalia Speaks To Tea Party Caucus, Democrats
by Nina Totenberg
January 25, 2011
When Supreme Court Justice Antonin Scalia accepted an invitation from the Tea Party Caucus to brief its members on the Constitution, controversy threatened to engulf the event. But the caucus then broadened the invitation to include Democratic members of Congress, too, and on Monday night there appeared to be more fizzle than sizzle to the charge of unseemly partisanship by a Supreme Court justice.

Legal ethics experts largely agreed that Scalia violated no ethics rules, especially because he has spoken to liberal as well as conservative groups in the past.

I think this is a good thing. I think it should be done maybe monthly, with a quiz at the end.

- Stephen Gillers, legal ethics specialist

"There's nothing wrong with it," said Northwestern University Law School legal ethics expert Steven Lubet. "At most it's a question of prudence, not ethics," he said, "and though it seems to be controversial, it's not really any different than giving a lecture at a law school."

Stephen Gillers, a legal ethics specialist from NYU School of Law, said he views Scalia's appearance as healthy, and said he hopes the same group will invite other justices with views different from Scalia's.

But in times of crisis the wise build bridges, while the foolish build barriers. We must find a way to look after one another as if we were one single tribe.” -King T'Challa, Black Panther
