ParkCo inmates file class action lawsuit against PCSO, Department of Corrections

More than two dozen inmates at the Park County jail in Fairplay have filed a class action lawsuit against the jail, the Park County Sheriff’s Office, the Colorado Department of Corrections, and two U.S. corrections industry contractors — Trinity Serve Group Inc. and Securus Technologies — alleging the denial of privileges they claim are afforded to them as Department of Corrections inmates.

In the Nov. 17 filing, lead plaintiff Jerry E. Hegwood claims that he and 27 other inmates at the jail are being treated as county jail inmates instead of CDOC inmates, and are thus being denied access to the court system, the Colorado Offender Phone System, and programming and canteen options approved by the state corrections department. Hegwood and the other plaintiffs also claim they are being denied constitutional rights under the First, Fifth, Eighth and 14th amendments, including freedom of religion and the right to due process.
