Arraignment date set for Marshdale shooting suspect

Jefferson County Court has found probable cause to continue forward with the case of an Evergreen man accused of shooting and killing his tenant on May 20.

David Donald Claussen, 46, has been charged with second-degree homicide in connection with the death of 33-year-old Alexander Hudspeth, who was a house tenant at the time.

Claussen is scheduled for arraignment at 8:30 a.m. on Sept. 10. This will be his first chance to enter a plea.

An Evergreen man has been scheduled for a jury trial after he pleaded not guilty of shooting and killing his tenant on May 20.

During his arraignment Monday, Claussen pleaded not guilty to second-degree homicide. His motions hearing has been set for Jan. 11, 2019, and a jury trial scheduled for March 18, 2019.

During his preliminary hearing on July 27, the court found that there was sufficient evidence to allow the case to move forward, and bound it over to the district court.

Claussen found not guilty in death of tenant

David Claussen, 47, was charged with second-degree homicide in connection with the death of 33-year-old Alexander Hudspeth, who was living with the Claussens in the 7700 block of Highway 73.

He pleaded not guilty, and the jury trial started on March 18. Jury deliberations began on Friday morning, and the not-guilty verdict was announced Monday afternoon.

He said that he had no intention of firing the gun, but that Hudspeth had been throwing downward strikes on his shoulder and head, which he said had made him clench up and pull the trigger.

In the interview, he said, "The gun went off because I was being assaulted. ... It was not my intention to shoot Alex Hudspeth today."
