Affidavit: Murder suspect claims it was a ‘mercy killing’

The 67-year-old man accused of allegedly murdering his infirmed older sister reportedly told investigators that he did it as a “mercy killing.”


Alan Head was arrested Saturday at his home near the 1500 block of Highway 103 on suspicion of murdering his 74-year-old sister Mary Jo Head. She was found dead of a gunshot wound. He is being held in Clear Creek County Jail without bond on suspicion of first-degree murder.

Murder case bound over to district court

The criminal case against a 67-year-old man accused of killing his infirmed older sister has been bound over to district court.

During a motions hearing Thursday, the judge read the eight charges filed against Alan Head, including first-degree murder, second-degree murder, first-degree assault of an at-risk person — all felony charges — and neglect of an at-risk person. Several charges carry a minimum sentence of 16 years and a maximum of 48 years.

Alan Head told investigators that he contemplated his act for about two or three hours beforehand, stating that he also considered killing himself. He, however, didn’t do that, the affidavit states, because he was afraid the gun wouldn’t do the job.

He told investigators that he felt guilty that he’d killed his sister and that she didn’t want to die, the affidavit reads.

Court finds probable cause to move forward with case against Alan Head

The 68-year-old Clear Creek County man accused of killing his infirmed older sister is scheduled to enter a plea in January.

During a Nov. 18 preliminary hearing, the district court judge ruled there was enough evidence of probable cause for the case to proceed against Alan Head. He was arrested July 27 at his home near the 1500 block of Highway 103 in connection with killing his 74-year-old sister Mary Jo Head. She was found dead of a gunshot wound.

Eight charges have been filed against Alan Head, including first-degree murder, second-degree murder and first-degree assault of an at-risk person — all felony charges — and neglect of an at-risk person.

The judge said she believed Alan Head was a danger to the public and continued to deny him bail.

Head could enter plea next month

The Idaho Springs man accused of murdering his infirmed older sister could enter a plea next month.

During his Jan. 6 arraignment, Alan Head appeared in court but didn't enter a plea. He is scheduled for a disposition hearing at 9 a.m. on Feb. 24, and could enter a plea at that time.

According to court records from the Jan. 6 court appearance, the District Attorney's Office said that there may be a possible resolution at the Feb. 24 hearing.

Alan Head pleads guilty to second-degree murder

The Idaho Springs man accused of murdering his infirmed older sister has pleaded guilty to second-degree murder, a Class 2 felony, and a crime of violence, a sentence-enhancer.

Alan Head, 68, will be sentenced at 3 p.m. March 30 in district court at the Georgetown courthouse, and the minimum sentence he faces is 16 years in prison.

Of the eight charges filed against him, including first-degree murder, Alan Head has pleaded guilty to the two counts as part of an agreement with the prosecution.
