SB 13-196 a Very Very Bad Bill

01 Mar 2013 11:03 #11 by Something the Dog Said
Again, where in the proposed bill that supports your hysterics? The bill clearly exempts manufacturers and distributors from any liability if they lawfully sell their firearms. Sales to valid FFLs would qualify as a lawful sale, so they would be exempt from any liability. I just don't understand the hysterics. It only affects those who unlawfully sell their firearms or sell to those who they reasonably suspect might misuse them.

But Dave Kopel, a University of Denver law-school professor and a gun-rights supporter, said the bill is nothing but "a clever attempt to evade the (federal) statute."
"The point of the federal lawsuit is to ban lawsuits against gun companies for properly functioning guns," Kopel said.
He also said the bill's definition of "assault weapons" includes double-barreled shotguns and even some single-shot rifles.
"The gun definitions are written by people who know nothing about guns and have crazy results," Kopel said.

So a law school professor questions the definitions of firearms in the bill? Is that what makes it a "Very Very Bad Bill" that will prohibit the sale of firearms in Colorado?

I think I will trust what Dave Kopel has to say over the Dog. Even the Denver Post thinks it may run afoul of the federal law.

I am not taking anyone's word for why this is a "Very Very Bad Bill", but just trying to understand why it is a "Very Very Bad Bill" without the hysterical hyperbole unsupported by the language of the actual bill.

Just for grinnnnnssss......Easily in most home shops a gun can be fashioned from randomly selected parts......not rocket science. No need for a background check to fab a custom gun (firearm) parts......are the feds going to have a serial on each of several thousand parts.....tracked and registered.......this is silly shit but headed that way. The ammo is as many know a minor consideration
get the reload memo ??

Custom guns are happening.....buy 50% of the firearm on line from vendor A.....and the remainder from other vendors/people......there laws are doomnd before the ink is dry.

The terms:
FAILURE TO EXERCISE THE HIGHEST DEGREE OF CARE
NEGLIGENTLY ENTRUSTS THE ASSAULT WEAPON TO A THIRD PARTY
THAT ASSAULT WEAPONS ARE SOUGHT AFTER BY AND ARE USEFUL FOR CRIMINALS, MASS KILLERS, AND THOSE WITH CRIMINAL INTENT BUT ARE RARELY NECESSARY FOR LAWFUL PURPOSES

Are of no concern? What is the highest degree of care, Negligently entrusts?

Larry the Lawyer " So Mr. Gun Dealer were you truly using the highest degree of care when Mrs. Smith over there bought 3 .22 caliber semi- automatic rifles and a case of ammo, all on the same day? Wasn't it a bit unusual?

Why should the owner of an "assault weapon" that is stolen from a vehicle be liable for all injuries and damages caused by the individual who stole the weapon?
