Your right, that was embarrassing for Gore; who also first ran to Larry the Lawyer to ask him to find some way, any way, to change the outcome when the people spoke. From the decision:DENVER — Late Wednesday afternoon, Colorado Deputy Secretary of State Suzanne Staiert ruled against state Senate President John Morse and decided that a recall election against the lawmaker should move forward.
Colorado courts have consistently held that headings may be properly used as an aid to construe statutes. If the people, in adopting the constitution, and the legislature, in adopting Article 12 of the election code, intended a statement demanding the election of a successor, they would have placed the "demand" provision in the section governing the form and requirements of recall petitions. But the people and the legislature did not do so; rather, they placed the general "demand" language in the sections that provide the legal authority for recalling state officers. Doing so shows that they never intended the inclusion of such a statement on the face of every petition section.

The release also included kind words from Denver Clerk and Recorder Debra Johnson, a Democrat who has tussled with Gessler’s office over whether inactive voters should receive mail ballots. Johnson worked with Staiert when Johnson was the Aurora city clerk.
“Suzanne is an energetic, level-headed professional who will be a great asset to the Colorado Secretary of State’s office. She is an exceptional elections attorney,” Johnson said.

As I've noted elsewhere, Democrats are only interested in the democratic process when they have the majority. When they lack it, the last thing they want to see happen is the will of the people followed. It's so refreshing to see them remain consistent on something.Staiert most recently worked as an associate municipal judge for the city of Centennial. She also has been assistant county attorney for Arapahoe County, an associate judge for Aurora and Centennial municipal courts and assistant city attorney for the city of Aurora.
