But the bears are caged up...the humans have invaded their habitant and destroyed their berries and other food sources. Bad humans!

Samuel Walker, the Florissant man who pled guilty to one count of felony aggravated cruelty to animals on Dec. 15, was sentenced on Feb. 7 to 90 days in the Park County Jail for his role in the deaths and starving of dozens of dogs.

Animals are property.
If a man abuses his property, it is a shame. It is also a crime with penalties.
But in the case of starvation it must be shown that there is a disparity between the health of the animal owner and that of the animal. If the owner shares the same condition of starvation as his animals, then he has most probably fallen upon extremely hard economic times and both he and his animals are starving to death. They are sharing a common fate and no crime has been committed. However, if the owner is fat and sassy while his animals starve to death, then this would show that he has withheld food that should have been shared with his animals.

Two years to build their case? That is ridiculous. Maybe the defense attorneys delayed and prolonged the process. I would suppose that charges should have been filed within a month considering that scientific examination and expert opinion had to be gathered.

90 days in jail with work release? Felony conviction. This fellow has lost his right to own a firearm for life. Think of it! He can no longer hunt quail, squirrels, waterfowl, or big game. The sentence was probably severe enough to deter him from doing this again.

Charging and convicting his wife is questionable. Most usually the mate of a criminal has no choice but to live their life as best they can. A person who would starve his animals probably would abuse or threaten his mate (who knows?). His wife was most probably trying to survive also. She is probably a victim also. The DA was wrong on this one.
