Why involve the courts in a private business decision? Employment is at will in this state. Your son-in-law could be fired because the company doesn't like his hair cut or for no reason at all other than the boss decided not to employ him. If the company has a no drug use policy, then regardless of a medical card allowing him to use marijuana to treat whatever debilitating condition he happens to suffer from, the company has the right to dismiss him. He doesn't have a right to be employed by a company that prohibits the use of marijuana by its employees regardless of whether the state has decided to allow certain people access to that drug.

As Medicine Man is quick to point out, Medical Marijuana is not a prescription medication and thus the rules for its use in the workplace are not the same as they are for prescription medications. Alcohol is a legal substance, but you can be fired for having it in your system when you show up for work if that is part of the rules of your employer. A police officer is not allowed to have even a trace of alcohol in their system during their shift, neither is an airline pilot. The rules of your son-in-law's former employer prohibited the use of marijuana by their employees and your son-in-law violated those rules and lost his job for doing so. If the company had a policy against visible tattoos or body piercings for their employees and your son-in-law violated those policies he could be terminated for those violations as well. The court has no jurisdiction at all in the matter, absolutely none.

First of all, my son-in-law did not test positive for anything and thus has his job. I was sharing what happened at his place of employment.

I agree with most of your post PS. Because it is not prescribed by doctors, which they can't because you can't buy it at the drug store, yet, I believe the card means nothing in the work place.

But, I do believe it may go to the courts.

My apologies Gringa - when you wrote that 6 of them lost their jobs, it seemed to follow that one of the 6 was your son-in-law. I should not have made that leap.

If it does go to a court, the only reasonable action for the court to take would be to refuse to hear the case since it would have no basis upon which to render a ruling.

And ditto on the pain meds. I finally found one that worked but the rest just made me not care about the pain, didn't relieve it. They also made me not care about anything much at all. The only pain med that actually relieved my pain was 120 mg of morphine a day..... hummmmmm, 120 mg of morphine or a couple of hits off a pipe through-out the day, geeeeee, I can't decided which to do.......

And it is precisely because the drug stays active in the system for such an extended period of time that companies don't want employees who smoke pot working for them and use the drug testing to screen them out. You don't have a right to be employed by anyone - at least not yet, though I'm sure the Democrats are working on a way to "fix" that problem too. You are free to start your own company and not ever worry about drug testing again if you wish.

Oh, I'm not terribly concerned about it. It was nice to sleep well for a couple of months, but to be honest, I did notice that I had a hard time concentrating at work. I kept getting the urge to pick up guitar and start playing folk music.
