The President is not involved in personnel decisions at any level below the appointment of IRS Commissioner. But you knew that.

But a normal POTUS can make his will done...but not this one who is so hands off right?

Lois Lerner lost her rights

House Oversight and Government Reform Committee Chairman Darrell Issa said embattled IRS official Lois Lerner waived her Fifth Amendment rights and will be hauled back to appear before his panel again.

The California Republican said Lerner’s Fifth Amendment right to avoid self-incrimination was voided when she gave an opening statement this morning denying any wrongdoing and professing pride in her government service.

“The precedents are clear that this is not something you can turn on and turn off,” he told POLITICO. “She made testimony after she was sworn in, asserted her innocence in a number of areas, even answered questions asserting that a document was true … So she gave partial testimony and then tried to revoke that.”

He said he was not expecting that.

From what I am reading, he may be able to call her back, but she probably didn't revoke her right to plead the 5th by giving an opening statement, and she probably can continue to plead the 5th even after the statement, even after answering a/an question(s).

I can only wonder how well it would go if the IRS called me to appear before them and I told them I did nothing wrong, and then I refused to answer any other questions. Based on Lerner, it sounds like a great strategy to me! :woo hoo:

The IRS has placed embattled agency official Lois Lerner on administrative leave, according to a congressional aide.

Lerner is at the center of the controversy over the IRS’ targeting of conservative groups that were seeking tax exempt status. On Wednesday, Lerner invoked her Fifth Amendment right not to incriminate herself during a House Oversight and Government Reform Committee hearing.

The decision to place Lerner on leave follows days of hearings where lawmakers from both parties heavily criticized the agency for its targeting of conservative groups. President Barack Obama and Treasury Secretary Jacob Lew have promised to identify and take action against any officials who acted inappropriately.

Acting IRS commissioner Danny Werfel named Ken Corbin to be the new acting Director of Exempt Organizations in a statement released Thursday, which did not mention Lerner. Corbin was previously a deputy director in the agency’s wage and investment division.

Lerner will continue to be paid while on leave per civil service rules, according to a congressional source.

It’s difficult to fire a civil service employee because the termination can be appealed to the Merit
Systems Protection Board—a process that can take over a year.

But the first step is to place the employee on paid administrative leave and then – if the decision is made to fire them – give them 30 days to respond. If the decision stands, they can appeal to the board, but they’re off the federal payroll while that happens.

Well we're still paying Nidal Hassan and he killed 13 people in an act of "workplace violence", so in comparison, Lois is a stellar employee of the people and really shoulld get a bonus for good behavior.
