Ever see all the ads on daytime tv from lawyers trolling for "victims"? It doesn't always matter if you didn't read the fine print, these leaches will find a way to extract money. We also know that putting smoke into your lungs is not a good idea, or spilling hot coffee on your lap could be an issue, but lawyers always find a way. Sorry, but not everybody accepts the risks they have knowledge of and lawyers capitalize on it. There are bad doctors who make bad decisions, but not all malpractice suits are justified... I'll bet most are not. My opinion.archer wrote: And you knew going in, or should have known, that the chemo drugs were poison, would cause you all kinds of side effects, none of them pleasant, and there were no guarantees, only hope, that they would kill the cancer before they killed you. That's the risk we take Rick. It was all spelled out for me before I started chemo, and I hope it was for you. I see no relationship to malpractice there. Try a different analogy.

There are legitimate cases against doctors who are negligent, who practice bad medicine, who operate when they know, or should know, when they are impaired, there are also those who cover for them. I also know their are good doctors who are falsely accused, and frivolous casess are prosecuted. I just have concerns about legitimate cases being limited because bad cases exist. How do you put a dollar value on a life lost of ruined? I think most cases that end up in court are about unexpected consequences of medical treatment. In cancer treatment there are so many possible consequences how can one be really unexpected? I have 2 stents in my coronary artery because my artery reacted badly to one chemo drug..... But who knows, maybe that was the one which killed the cancer. I don't think any lawyer would take a case like that....

Yes, god forbid we "take on the trial lawyers"...Blazer Bob wrote:

Tort reform is not a carte blanche for medical malpractice.

LJ's definition of success is right in line with the president's I see. Oh and that race card thing never gets old does it? Pathetic.
