LAKEWOOD - A Colorado case to be heard by US Supreme Court next week could adjust the balance between gay rights and the rights of religious people who believe homosexuality to be sinful.

The dispute happened five years ago in a small strip mall bakery in Lakewood called Masterpiece Cakeshop.

Colorado has what's called a "public accommodation" law. It's the same law that bans restaurants from refusing to seat you because of the color of your skin, only Colorado's version also protects sexual orientation.

The state civil right's commission came down on the side of the couple.

And that decision is the subject of this lawsuit: Masterpiece Cakeshop v. the Colorado Civil Rights Commission.

The cake shop lost at the state court of appeals. The Colorado supreme court didn't want to hear it. They let that ruling stand.

But the US Supreme court is interested and took the case. Its decision could go beyond Colorado.

The oral arguments start 8 a.m. Colorado time on Tuesday and then we could wait a while for a ruling.

Perhaps they could have avoided all of this, if their priorities are as they claimed (religious beliefs over public commerce) by being more specific in their business description. If they had named their business to suit their target market, like "The Bible Bakery" or "Mainstream Bakery", they could have avoided this in the first place. I did business with many people with whom I did not always agree, but didn't refuse to do business with them. Business is public, personal beliefs are exactly that--personal. If your priority is being an evangelist, rather than a business owner, set it up as a private entity and promote your business through the various churches, select non-profits, etc. It's like a gas station who only wants to sell gas to those who are a member of your political party---

Masterpiece Cakeshop, Colorado settle legal battle

The state of Colorado has agreed to settle its legal dispute with Masterpiece Cakeshop and its owner, Jack Phillips, over the shop's refusal to make a custom cake for a transgender woman, Colorado Attorney General Phil Weiser announced.

The two sides "have mutually agreed to end their ongoing state and federal court litigation," an announcement Tuesday from Weiser's office said.

The state and Phillips have been battling for years over his refusal in a pair of well-publicized cases to design custom products for LGBTQ customers. Phillips has maintained that to do so would violate his religious beliefs, adding that all customers are free to buy non-custom products at his Lakewood shop.

"Under the terms of the agreement, the Colorado Civil Rights Commission will voluntarily dismiss the state administrative action against Masterpiece Cakeshop and its owner, Jack Phillips, and Mr. Phillips will voluntarily dismiss his federal court case against the state," Weiser's office said.
