So what is being proposed here is not a referendum, which would be the citizens demanding the ability to have a direct say on HB 13-1224 themselves before it becomes effective. No, what Misters LeVier and Davis are in the initial stages of is a citizen initiated amendment to the Colorado Constitution itself, which you have already acknowledged is one of the powers which the citizens of Colorado have. Given this fact, one has difficulty understanding why you persist in trying to defend a premise which is demonstrably flawed rather than simply admit your error.

No one is asking that HB 13-1224 be referred to the citizens to decide, which would be a referendum prohibited by Article V Section 3 of the Colorado Constitution because the Democrats decided to stick some language at the end of it specifically to prevent that from happening. Why they would deliberately seek to prevent the citizenry from having the power to conduct a referendum by inserting this clause is curious given what they claim is overwhelming support of the citizens for the proposal. If they were so sure that the majority of the citizens of Colorado supported what they were doing, why would they intentionally and deliberately take steps to prevent them from having a direct say in the matter? Could it possibly be that they intend to prevent that from happening precisely because they know that the majority of the citizens of this State oppose their efforts instead of support them?

Since magazines don't have serial numbers or manufacture dates, how do the idiot Democrat legislators believe there can be a grandfathering of magazines of more than 15 rounds? They already wish to trample our second amendment so maybe just throw out the presumption of innocence as well. When the law enforcement community refuses to enforce these laws, it is for multiple reasons. One, it violates our second amendment rights, which are not granted by the government, but simply reiterated. Second, they will not be able to determine if the magazine in question is in violation of the ridiculous law. Colorado law can not extend beyond our state, so serializing or date stamping are another pipe dream.
The universal background check has no basis in reality either. Gun shops already do these and making a law that requires it of everyone clearly shows how inept our Democratic legislators are. Presently an FFL dealer has access to CBI background checks by phone or online. How does the ordinary citizen? They don't. Gun shops will not run background checks for private sales for several reasons. One, there is no money in it, ie. it will cost more in time than the legislation allows in the fee. Second, since we run all serial numbers of guns that we sell as used or on consignment to verify that they are not reported stolen. We will never assume liability for private gun sales.
So niether of the above mentioned bills will be enforceable, how much more time can be wasted in an attempt to punish the law abiding citizen?

I have here made this point multiple times......these laws are liberal wet dreams.....magazines and background checks that is....not workable and indeed police state control tatics.....citizens will be arrested with 30 round mags and the burden of proof of purchase date will br vectored to the innocent........a common practice. Germany Circa 1935.

thanks for the vote data......we also want 3-5 recalls initiatives........and then take back CO legislature 2014.....the over reach by the left wing politicians is a great opportunity for conservatives to reap the benefits of their faults.
