Don't attack me. I don't live in Park. This has nothing to do with me. All I care about it keeping the forums running so everyone, INCLUDING YOU, has a place to discuss the issues without being muted as you say. You have a good thing going here so chill. If the thread deteriorates into constant name calling with no content the post will be moved to the more appropriate forum. That is all I have an issue with.

Good morning everyone and thanks for the comments and continuing questions about 5A.

Several people have wondered about why non-Park County residents have a say on 5A. Non-resident property owners have the right to vote on 5A and they can request ballots from the Clerk and Recorder in Fairplay. Center of Colorado is funded by the 1 mil property tax, thus all property owners who live in Colorado and own property in Park County have a stake. Though 5A is not asking for a property tax rate increase and any loans that may be taken will be repaid only with existing revenues of the District, the water conservancy district statute and election law allows these property owners to vote on this issue.

Tilt has several good questions which I will address here. First, why choose Park County for 5A. Actually, Park County is the only county that could be chosen. Center of Colorado is strictly a Park County entity. It’s jurisdiction is Park County and it is funded only by Park County property owners.

Second, regarding who signs the loan and who is responsible to pay it, the loan is only between the lender and Center. The Board President will sign the loan on behalf of the District. There are no personal guarantees like you may have in other loan situations. Also, as I noted yesterday, the collateral for any loan will be otherwise uncommitted District revenues. Taxes cannot be raised to pay the loan and the lender is accepting the promise of the District that the loan will be repaid.

AVs Good Twin asked about the water the Districts provide to the Road and Bridge department. The water is pumped from various places by R&B and put in water trucks for use around the county. There are pump locations on Deer Creek, the Middle Fork of the Platte, Tarryall Creek and Sacramento Creek.

2. Does Center of Colorado team up with Park County L&WTFB on any issues? Such as the ball fields issue in Burland?

3. Is there a web site for this organization?

4. If you aren't affliliated with Park county government, but are financed through a Park County mil levy, who are you accountable to? (Hope I understood this correctly.)

5. Is the mil levy granted to infinity? Is there a time limit on this?

6. Where do we find the history of this organization? Where are all papers concerning it?

TO VOTE ON THIS ISSUE, YOU NEED TO OWN PROPERTY IN PARK COUNTY AND LIVE IN COLORADO. OUT OF STATE PROPERTY OWNERS CANNOT VOTE ON THIS ISSUE. CENTER MAILED OUT THOUSANDS OF THE ELECTION NOTICES TO NON-PARK COUNTY RESIDENT PROPERTY OWNERS WHO LIVE OUTSIDE OF PARK COUNTY BUT WITHIN COLORADO.

2. Does Center of Colorado team up with Park County L&WTFB on any issues? Such as the ball fields issue in Burland?

THE L&WTFB IS A SEPARATE ENTITY CONTROLLED BY THE COUNTY AND THE BOCC. THE BOCC APPPOINTS THE BOARD MEMBERS OF THE L&WTFB. CENTER HAS NOT BEEN INVOLVED IN THE BURLAND BALL FIELD ISSUE. CENTER'S BOARD IS APPOINTED TO FOUR YEAR TERMS BY THE DISTRICT COURT JUDGE PER THE STATUTE. ANYTIME THERE IS A VACANCY ON THE BOARD, CENTER ADVERTISES IT AND THEN PEOPLE APPLY FOR THE VACANT POSITION. THE JUDGE THEN APPOINTS TO FILL A BOARD VACANCY FROM THE PERSONS WHO HAVE APPLIED.

3. Is there a web site for this organization?

CENTER DOES NOT HAVE A WEBSITE YET BUT IT HOPES TO HAVE ONE IN THE NEAR FUTURE.

CENTER IS NOT PART OF THE BOCC OR ANY OF THE COMPONENTS OF THE PARK COUNTY GOVERNMENT (i.e., THE ASSESSOR, TREASURER, PLANNING AND ZONING, etc....). IT SOMETIMES WORKS WITH THE COUNTY ON ISSUES SUCH AS OUR JOINT OPPOSITION TO SPORTSMEN'S RANCH AND THE JOINT OPPOSITION TO WATER CLAIMS BY VERN WAGNER, BUT CENTER AND THE BOCC/COUNTY ARE SEPARATE AND INDEPENDENT ENTITIES. CENTER IS FINANCED THROUGH A ONE MILL PROPERTY TAX THAT WAS AUTHORIZED BY THE VOTERS IN THE 1997 ELECTION. THE TAX IS COLLECTED AND REMITTED TO CENTER AS THE TAXES ARE PAID. CENTER IS NOT ACCOUNTABLE TO THE BOCC, THE L&WTFB OR ANY OTHER PARK COUNTY ENTITY. CENTER IS REQUIRED TO FOLLOW THE WATER CONSERVANCY DISTRICT STATUTES AND ULTIMATELY IT IS ACCOUNTABLE TO ALL OF YOU, THE CITIZENRY. IF THE CITIZENRY DOES NOT LIKE SOMETHING CENTER IS DOING, THEN YOU CAN DELIVER THAT ACCOUNTABILITY. CENTER IS A WATER ORGANIZATION AND IT TRIES TO STAY IN THAT ARENA AND AVOID THE POLITICAL FIGHTS WITHIN THE COUNTY.

5. Is the mil levy granted to infinity? Is there a time limit on this?

THE ONE MILL TAX WAS APPROVED IN THE 1997 VOTE THAT LED TO THE FORMATION OF THE ORGANIZATION. THE L&WTFB 1% SALES TAX DID HAVE SUNSET PROVISIONS IN IT AND I RECALL IT WAS RECENTLY RENEWED FOR 10 OR SO YEARS. CENTER'S MILL LEVY IS PERPETAUL AS THAT IS HOW IT WAS APPROVED BY THE VOTERS IN 1997.

6. Where do we find the history of this organization? Where are all papers concerning it?

CENTER STARTED AS AN OUTGROWTH OF THE EFFORT TO DEFEAT THE PARK COUNTY SPORTSMEN'S RANCH PROJECT. THE PEOPLE WHO WERE INSTRUMENTAL IN CREATING CENTER IN 1997 WERE PART OF THE PARK COUNTY WATER PRESERVATION COALITION, WHICH WAS A NON-PROFIT CONTRIBUTION BASED ORGANIZATION. THE PCWPC MEMBERS REALIZED IN 1996-7 THAT SIGNIFICANT AMOUNTS OF MONEY WOULD NEED TO BE SPENT TO DEFEAT THE SPORTSMEN'S RANCH SCHEME SINCE SPORTSMEN'S RANCH AND AURORA WERE THROWING 7 MILLION DOLLARS AT IT. THE PCWPC CONTRIBUTIONS WERE SIGNIFICANT BUT VOLUNTARY (RAISED THROUGH BAKES SALES, SOLICITATIONS, etc...), BUT PCWPC KNEW THAT A MORE STEADY FUNDING STREAM - IE., A PROPERTY TAX - WOULD BE NECESSARY TO DEFEAT SPORTSMEN'S RANCH AND TO FUND AN ORGANIZATION INTO THE FUTURE TO DEFEAT ANY SUCH NEW SCHEMES THAT CAME ALONG. THAT IS WHY THE 1 MILL TAX WAS PUT IN PLACE.

FORMING A DISTRICT IS A COMBINATION OF PETITION SIGNATURE GATHERING FROM PROPERTY OWNERS, A COUNTY WIDE ELECTION AND A DISTRICT COURT PROCEEDING TO VALIDATE THE WHOLE PROCESS. THAT PROCESS IS FOUND IN TITLE 37, CHAPTER 45 OF THE COLORADO STATUTES. THE PARK COUNTY DISTRICT COURT HAS A CASE FILE IN CASE NO. 97CV64 WHICH HAS THE COURT'S PAPERWORK AS WELL AS RECENT FILINGS THAT RELATE TO DIRECTOR APPOINTMENTS OVER THE YEARS. CENTER HAS ORIGINAL PAPERWORK BUT MOST OF IT CONSISTS OF THE SIGNATURES, ELECTION STUFF, ETC. . .

I never knew the Center existed. I thought everything we did back in 1997 was the L&WTFB.

My eyes are opening. :thumbsup:
