So….the next round of lawsuits will be to declare that the “mandate”…er…”tax” is not a lawful tax. Roberts is either sly as a fox or too clever by half.

I was under the impression Obama's healthcare mandates were to force businesses to buy insurance not to force citizens to buy insurance. This is just a foot in the door. IF the republicans can't use this to get him out of here they don't deserve to win. Romney needs to get it together and stop going for the vote he already has.... the confirmed republicans and look at the undecideds and what they want.

Wow, really? What a great campaign-speech line--that is so wrong on so many levels. At least Romney has raised bloviating to an art-form... Someone should tell Romney what he could..and couldn't..do as president.

But what is obvious is that the Republicans NEVER HAD A ALTERNATIVE PLAN... Their only plan was to return control back to the health-care and pharma industries and tell the American people, "screw you"... Romney doesn't have a plan...He just wants to be president.

President Barack Obama, for his part, told CNN in September 2009 that the penalty is "absolutely not a tax."

Internal Memo Confirms Big Giveaways In White House Deal With Big Pharma

A memo obtained by the Huffington Post confirms that the White House and the pharmaceutical lobby secretly agreed to precisely the sort of wide-ranging deal that both parties have been denying over the past week.

The memo, which according to a knowledgeable health care lobbyist was prepared by a person directly involved in the negotiations, lists exactly what the White House gave up, and what it got in return.

It says the White House agreed to oppose any congressional efforts to use the government's leverage to bargain for lower drug prices or import drugs from Canada -- and also agreed not to pursue Medicare rebates or shift some drugs from Medicare Part B to Medicare Part D, which would cost Big Pharma billions in reduced reimbursements.

It's also going to be interesting to see how the Romney camp tries to spin this, since RomneyCare has obviously been so successful, and the Constitutionality of ACA has been upheld...So, the best he's got now is that it "shouldn't be done at the federal level"? Good luck with that one...

My guess? They don't have an alternative plan; if they DID, guess how many votes they would need to get it past the Senate...(What? 60 votes?!?) Really? What are the odds...? Romney better pivot to something else like offshoring/outsourcing jobs and his "experience as a businessman" creating jobs (in China, Singapore, India, Mexico, ...), because if he tries to campaign on health care, it's a no-win...

If you bother to read the decision, Roberts held that the penalty was within the taxing power of Congress, thus legal.
