You're not precise in your headline. They struck down the mandate under the Commerce Clause... they defined it as a tax.
Verrilli had to be careful, though. While he insisted that the penalty is not a tax for Anti-Injunction Act purposes, he is expected to argue as the case proceeds that Congress is within its authority to pass the health-care law in part because of its ability to tax.
“Today you are arguing that the penalty is not a tax,” said Justice Samuel A. Alito Jr. “Tomorrow you will be back and arguing that the penalty is a tax.”
The administration kept insisting it wasn't a tax. Well... it is a tax. Hey Obama... go to the 78% of Americans who are against this whole bill and on the stump... tell them it's really a tax. That should go over like a rock. And they narrowed the Medicaid expansion. That's not a victory for Obama. Tell the old folks that Medicaid is not going to be expanded.
It may be a hollow victory for the administration. We'll see.

The left is angry because they are now being judged by the content of their character and not by the color of their skin.

The ruling clearly indicates that if it were a penalty and not a tax that it wouldn't be constitutional. The Supreme Court rejected it under commerce clause and necessary and proper clause arguments and upheld it under the power delegated to tax. It is not a penalty Raees, it is a tax.
It'll be interesting to see if this hurts Obama/helps Romney since so many seem to be opposed to it. Between this and the economy I believe we have all our attack ads laid out for us for the next 5 months!

And the taxes are fairly low. So you might be better off just paying the tax instead of buying insurance. The preexisting condition provision survives, but if people prefer to pay the tax, then the insurance carriers won’t get the funds they needed to cover the high-risk patients. I see new rate increases for everyone.
Can Romney really attack Obama on this being a tax when that is what he did over and over again as governor, use fees/taxes to fund government programs.
