since it is public record it shouldn't matter. do you have to pay to see the transcript or have it transcribed since court proceedings in park county are recorded w/o court reporter?

Totally agree with what your dad said about getting a petition started to be put on the ballot. Had some of the propositions passed last Nov, they would have taken care of this subject.
Not to argue, having been trained in the courts, the role of the clerk is to be impartial, & cannot give any legal advice, therefore, anything someone wants to submit to the crts has to be date stamped, taken in & presented to the judge. It is not the clerk's decision what may or may not be submitted to the judge. If the clerk of court is instructed by the judge to handle a case in a certain way, then that is different, but it is never a blanket procedure on how to handle all filings. On some filings they may look to make sure all forms are there as in divorce filings.
I am also familiar with as you call them (bozos) good name. Yes, it sticks in my throat to call any of them "your honor" . Mr chief judge is right in with groome having seen some of his last rulings. He has scumbbed to the evils of the commissioners & county atty. Very sad for the resident taxpayers of this county. He does not live here, so what does he care. You could be right on with your take in numbers. I would hope it would more than anything make them uncomfortable. When the last 2 district & county crt judges retired, we the citizens of park county lost 2 wonderful men of integrity, fairnes, knowledge, kindness & compassion. What a great loss for all of us....
you are right about being able to submit anything you want to the clerks. however because of ethics requirements the judge can only look at the actual filing papers and testimony in court. he is not supposed to read anything submitted outside of that including the newspaper or talk to anyone regarding the case - all ethics requirements. violate those and the case can be thrown out.

To: mtntrekker, thank you for your input. In regard to getting a copy of the case or what transpired in crt. There are several different ways.
BTW, I do think I remember this case. And, yes this is all public record & cannot deny, unless directed otherwise.
1. Can request a copy of the "Register of Actions". This will be a print out from the crt computer with all that has transpired in the case. Simply, have to have a name or case #. Unless, things have changed, a person can request this by phone, send in a self addressed stamped envelope, maybe .50cents per page, which they will be able to say on how many pages it will be. To me, this is the cheapest & easiest.
2. Can request a hard copy of the case itself with all the original pleadings. May have to sign a request form. Not sure on price per page. Maybe a .75/page. Here again, do not know if they still are mailing these out when sent proper postage & self addressed envelope first.
3. Can sign up with Co. Courts giving your cardit card. Not sure if there is a sign up fee, but can ask a friend of mine who is signed up with this procedure. Every case you look at is $5.00 charged to your credit card. I have had this person look up things for me & simply give the $5.00 to them. To me it is the most private & less time. I may start to do this for myself.
4. Of course you can request the actual audio from the crt CD. It is sent off to make a copy. Not sure of cost.
Did you know you can look at the crt docket in any county every week at no cost? It lists all cases, time, & what they are. No cost. Does not say what they are about, but if you know the types, then it is not hard to figure out. I look at 3 counties every week.....
lately i have been watching adams county, a judge in particular who tends to file in favor of the banks on foreclosure no matter who shows up for court. and parkco mostly to see which judges are handing out arrest warrants like candy to the sheriff's office. it used to be that one of the judges that i think you liked in county court did that on such a regular basis that i am glad to see him gone. it took enough filings of ethical complaints before he finally stepped down.
a friend of mine is wanting to file an ethics complaint against groome in this case but i don't know if she has standing and to ask either av8or or nmysys to do it might make it more difficult if the court reverses and sends it back for a judge to redo. filing it in their appeal makes sense. but even though judges aren't supposed to be swayed by any filing of ethics complaints against any of the judges, barton has been known to smack anyone who comes before him pretty hard if he knows that an ethics complaint was filed against one of his judges. we have seen this several times. barton will go out of his way to make rulings not based on any evidence whatsoever. hard to consider him 'your honor'.
my father will be the first to tell you that you can't get a fair hearing in this judicial district. it will always be in favor of the commissioners, even when an appeal reverses and it is sent back to the local judge with specific instructions.

You are welcome. Boy, you have got my mind racing. I never heard of filing an ethics complaint & none that I ever was aware of regarding the county crt judge (who as I remember it simply retired on his own) Everything seemed to be fine. He was even doing some district crt cases at that time, since he did not have as much responsibility time with his family. The rule 120 filings are hard in my opinion for anyone to decide, even now with the extended time.
I am glad you are watching these crts. And, yes, to have the ethics complaint filed in the appeals would be better served. Very interesting about barton, something I did not know. Although, his ruling in the sanitation event never should have been. It was not his job to do that, simply to preside over the hearing. He could have a finding, but not a ruling. Will have to find out what happened today. I had looked over all the resolutions to be submitted today, but do not think it will do any good. Cannot believe he gave one taxpayer $30,000. Have not yet found the reason out on that one.
I think sending a letter to the state crt administrator gets a bigger response. I know of 2 instances where folks have done this. And, in one, they even forwarded a letter to the atty general, although, they sent it to the administrator. Believe me, both instances shook them up in this crt. No one got fired, but they were put on notice. If anything is filed in pk co crt it gets pushed under the carpet, just as barton would do. Former employees who simply walked out have gone to the state crt administrator. So, this crt has a history with the state. The only thing the crt administrator in pk co would have to do if a judge change was requested is follow the law to review it as I said before. He is another cover up guy. The more I think about it, if there is no appeal filed, this might be the way to go. Right to the top!
