Helping prevent and fight wildfires is one of the top priorities for Colorado lawmakers in both parties this session. But so far, substantial policy changes recommended by the Governor’s wildfire task force are being rejected. As Bente Birkeland reports, the current package of legislative proposals is not nearly as aggressive as some would like.

Apologies to our neighbors for being silent these past months. We know we owe you an update and plan to get out a more complete update soon when we are less exposed.
In short, what has transpired the past year has been a never ending battle with the State AG and his army of lawyers. After we were thrown into court, a month after promises in June 2012 by the governor of quick restitution, there has been nothing but delays and dirty legal tactics by the state. We are being treated as enemies of the state. We are openly criticized in the press by the AG for being litigious, when it was his actions that forced us into the courts... Something non of us wanted to do. The handful of homeowners that have settled directly did so for a variety of personal reasons and we certainly respect what any homeowner does in their own best interest.
This is not over... The majority of homeowners have not settled with the AG on his terms, which appoints him as judge and jury, or received any restitution. We just wanted you to know....
Matters are at a very sensitive juncture... More to come when we can speak more publicly about this. Thanks for being there for us.. You support means everything to us.
I'm so sorry to hear this is still dragging on. Please let us know if there's anything else we can do to support you, you have it 100% and then some!

I would be remiss in not recognizing a terrible anniversary today. My heart, and hope, continues to be with you all in your struggle. I wish you strength, perseverance, and peace through your continued trials, and grief.

"Make it right, please."

PLEASE remember this when our fire season is in a SERIOUS STATE this summer....RULE NUMBER
ONE......YOU are responsible for YOU....do NOT wait to be told what to do.....self-reliance is

Yes, erring on the side of caution and listening to your gut is always good generally speaking.
As to this matter however, both the Lucas's and Ann Appel was packing to get out; the Lucas's were hit by a 60 mile an hour fire front that was burning at over 2,000 degrees, we had an inadequate and flawed reverse 9/11 system, and many other complications. But this fire was not a naturally caused fire - it was deliberately set and deliberately left unattended during dangerous conditions; they should not have had to lose their lives. The survivors should not have had to go through hell the past 2 years to gain restitution for lost income, lost property values, lost homes, lost loved ones, medical bills, etc. The state was negligent, retroactively granted immunity to itself and its workers who started this fire, and then have cost us taxpayers millions in attorneys fees fighting this when they should've done the right thing in the first place and paid damages so that our neighbors could rebuild their lives.
Considering that prescribed burns are still going on, how are we going to feel when the next one gets out of control and the state refuses to take responsibility for its actions? This isn't about evacuating properly, this is about trusting our elected representatives to be fair, honorable, and trustworthy and do the right thing. We need to stand together or this will happen again and we cannot allow those in our government who would try to get away with it.

Not only did the Claims Board not award any emotional damages, they also did not award any interest which was awarded by the Judicial Arbitrator Group (JAG). The JAG process was agreed to by the State (after they threw the victims into court a year and a half ago) as a way to determine the individual damages of each victim and now they are not honoring the JAG awards.
Each victim had to go through this process that was basically putting each of us on trial and being brutally cross-examined by the State AG's lawyers to prove damage. In addition to that in many cases the economic damages awarded by the JAG were significantly reduced by the State Claims Board... some reduced as much as 75%. Also keep in mind that because we were "joined to an existing court case filed by insurance companies by the AG office, any award amount will need to have attorney fees and any taxes paid from it so roughly speaking the victims will only see 50% of these awards at best.
While I am in TOTAL agreement with your statement of gov. responsibility and accountability,
I believe it is NOT a reality.....(not in today's cash poor/budget deficit fiasco)
